Application terms of service

Welcome to Joiin. These Terms of Service ("Terms") govern your use of the Joiin mobile application (the "App"), this website and our services (together, the "Services"). By using the Services, you agree to these Terms. If you don't agree, please don't use the Services.

1. Acceptance of terms

By accessing or using Joiin, you confirm that you've read, understood and agree to be bound by these Terms and our Privacy Policy.

2. Eligibility

You must be at least 13 years old to use Joiin. If you're under 18, you must have permission from a parent or guardian.

3. Description of services

Joiin provides instant group voice communication using a Bluetooth button connected to your smartphone. The app uses a freemium model, offering:

• Free use: limited by voucher code, group size or talk time
• Premium access: more talk time and larger groups, through paid subscriptions, one-time purchases or a club licence

4. Account registration and access

• You may need to create an account to use some features.
• You may be able to sign in with an existing Google account on Android.
• You're responsible for keeping your account and credentials secure.

5. Subscriptions and payments

• Some features need a paid subscription, a one-time purchase or a club licence.
• In-app payments are processed by Apple's App Store and Google Play. Club licences are invoiced directly by Morphic Technology Ltd.
• Subscriptions renew automatically unless you cancel before the renewal date.
• Refunds for in-app purchases follow Apple's and Google's policies.

6. Acceptable use

You agree not to:

• use the Services for illegal, harmful or abusive purposes
• disrupt, hack or interfere with how the App works
• misuse the Bluetooth connection or voice communication features

7. Safety

Joiin is a communication aid. It doesn't replace your own awareness, safety procedures, hand signals or the rules of the road or slope. Always use it in a way that's safe for you and those around you.

8. Termination

We may suspend or end your access to Joiin if you break these Terms.

9. Disclaimers and limitation of liability

• The Services are provided "as is", without warranties of any kind.
• We're not responsible for connectivity problems, device incompatibility or interruptions to third-party services.
• To the maximum extent permitted by law, we're not liable for any indirect, incidental or consequential losses.

Nothing in these Terms limits any liability that can't be limited by law, or your statutory rights as a consumer.

10. Privacy

We handle your data as described in our Privacy Policy.

11. Changes to these terms

We may update these Terms from time to time. If you keep using the Services after a change, you accept the new Terms.

Hardware warranty

This warranty applies to Joiin-branded hardware sold directly by Morphic Technology Ltd. Third-party hardware, such as Flic 2 buttons, is covered by its manufacturer's warranty.

Morphic Technology Ltd warrants that your Joiin hardware product ("the Product") will be free from defects in materials and workmanship for 12 months from the date of delivery to the original retail purchaser ("the Warranty Period"). If a defect arises within the Warranty Period, we will, at our option and subject to applicable law:

1. repair or replace it with a new or refurbished product or component; or
2. refund the original purchase price when the defective Product is returned.

This warranty doesn't apply to Products bought from unauthorised resellers, or where the instructions for use and activation haven't been followed, or where the Product has been damaged by abuse, accident, modification, moisture or other causes beyond our reasonable control.

Joiin hardware is designed for outdoor activities but isn't waterproof, and should be protected from water.

Battery wear is treated as normal wear and tear and isn't covered by the 12-month warranty. We'll only honour battery claims that arise within 6 months of the date of manufacture.

This warranty is in addition to your statutory rights, which it doesn't affect. All warranty claims and replacements must be authorised. See our returns policy below.

Returns policy

If the Product isn't what you expected, you may return all Joiin buttons bought in the original transaction, in their original condition and packaging with the original receipt, within 14 days of delivery. We'll exchange them or give you a full refund of the original purchase price.

This policy applies only to Products bought directly from us. If you bought from an authorised Joiin supplier, please contact the supplier. In some cases we may provide courtesy replacements even if you didn't buy directly from us.

This is in addition to your legal rights and to the 12-month warranty above. Before you return anything, please email jeremy@morphictechnology.com with your order details and the problem.
